TERMS & CONDITIONS
Covid-19 refund policy.
For new bookings on or after May-1, 2020 until April-30, 2021 deposits are refundable if covid-19 travel restrictions remain in place 90 days prior to Moon Tours travel date. At which point, 90 days prior to travel, invoice balance payments need to be made in full as per our general terms and conditions.
*TRAVEL INSURANCE / CANCELLATIONS & REFUNDS
Travellers must take out their own personal travel insurance at time of booking to cover any missed service or cancellations for any reason.
Moon Tours does not accept responsibility or give refunds outside our standard payment and refund terms and conditions listed below.
Moon Tours does not accept responsibility or give refunds of any kind with respect to any third party product or service, accommodation or tour provider. Any disputes, claims or refund requests will be at the discretion and subject to the providers terms and conditions. Moon Tours will assist should disputes and refund requests arise but is not liable or in a position to offer refunds on behalf of third party suppliers products and service as a booking agent.

Activities inside Australia; Moon Tours is insured for liability when conducting business inside Australia hosting 4WD tag-along tours. This does not include personal injury, medical evacuation, ambulance, vehicle, cancellation or any other type of insurance for individuals, groups or business partaking in activities with Moon Tours.
Activities outside Australia; Moon Tours is not insured or responsible for insurance coverage for individuals, groups or business’s as an agent for contracting parties outside Australia. Partners of Moon Tours listed on our website we believe to the best of our knowledge are fully insured and comply with all local laws within the countries they conduct business and offer their services. This does not included personal injury, medical evacuation, cancellation or missed services insurance. Every client travelling overseas must take out their own personal travel insurance to be covered.
FREE USE OF SUNOVA SUPs
If you plan on bringing your own board our boards cannot be allocated for back up boards and sole use. Any boards that have not been allocated for sole use will be available to use and demo from time to time throughout the tour.
Supplied boards are subject to availability and may change without notice or become unavailable. When you are allocated one of our boards that board will be considered yours for the entire trip. If you decide to let others use the board or swap boards around that is up to you. Consider the board yours and treat it as if it as such for the entire charter.
If you are trying, demoing or using any of the SUNOVA SUPs in our range it is your responsibility to inspect the board for damage before use. If you find any damage prior to use you need to let a Moon Tours representative know before use. Any damage found will be billed to the person who last used the board.
Minimum repair cost $100USD for minor repairs carried out on the trip.
Allocated surfers will be responsible for any repairs, professional or otherwise regardless of who or how the board is damaged. As it would be if it were your own board.
Major repairs on boards that need to be hand carried to Australia and repaired by professionals will incur further costs. Minimum charge $200USD
If the board is a write off, i.e. creased or snapped the allocated surfer will be responsible for the full second hand market value of the board.
It is your board for the trip and you will be responsible for it. If you believe someone else is responsible for damaging the board allocated to you Moon Tours will seek repair costs from you, the person the board is allocated too and it will be your responsibility to seek compensation from third parties if you choose.
Unfortunately we do not have the ability to make professional repairs in the Maldives. If the damage is minor and we can patch the board up to keep you on the water that does not constitute a professional repair.
These terms and conditions are legally binding between the traveller(s) and Moon Services Pty Ltd trading as Moon Tours, herein after referred to as Moon Tours.
ACCEPTANCE OF THESE TERMS
Acceptance of a quotation from Moon Tours constitutes acceptance of these Terms and Conditions which take effect immediately.
A 30% deposit is payable within 7 days of confirming a booking, with the final balance due 90 days prior to arrival. If a booking is made 90 days or less before arrival, the full cost is payable immediately. Last minute bookings are payable before arrival. Failure to pay on time may result in automatic cancellation of a booking with cancellation penalties payable to Moon Tours or 3rd party supplier. Please email proof of payment to your Moon Tours travel consultant. There is a fee for payments by credit card which is advised at the time of booking or making a payment. Generally 2.5% – 5% depending on the method of payment and currency.
NON REFUNDABLE DEPOSITS
Moon Tours reserve the right to withhold deposits for any reason. Travellers must take out personal travel insurance to cover any cancellations that may arise.
Deposits we receive from you the client are used to secure your booking and services with suppliers and are therefor subject to supplier terms and conditions and generally non refundable. Deposits may be refundable at the discretion of Moon Tours where direct cost of booking suppliers and tour expenses have not been incurred or in the event a supplier agrees to refund the holding deposit.
Within six months of travel, deposits for any trip are considered non refundable.
Moon Tours will accept deposits to be paid by credit card, bank transfer, cash or cheque and reserves the right to pass on any credit card, bank transfer, PayPal or any other fees associated with receiving the deposit amount.
BALANCE OF TOUR PRICE AFTER INITIAL DEPOSIT AMOUNT HAS BEEN RECEIVED
Moon Tours will only accept the balance of the tour price to be paid by bank transfer, cash or cheque and reserves the right to pass on any bank and transfer fees associated with receiving the balance payment. Moon Tours will not accept credit card payments for the balance amount outstanding.
All cancellations should be made in writing. Cancellation charges (calculated on the total value of the booking):
F.I.T (Free Independent Traveller) Individual bookings.
– If cancelation is received more than 90 days prior to arrival – 30% of the invoice value will be retained by Moon Tours.
– If cancellation is received less than 89 days prior to arrival – 100% of the invoice value will be retained by Moon Tours.
Additional fees apply for cancellation of airline tickets and other services, which will be advised as soon as possible after receipt of the written cancellation. Special cancellation terms apply for group bookings and exclusive use of a camp, lodge or boat, which will be advised at time of booking.
Group bookings and Private Charters.
– If cancelation is received more than 90 days prior to arrival – 30% of the invoice value will be retained by Moon Tours.
– If cancellation is received within 89 days prior to arrival – 100% of the invoice value will be retained by Moon Tours.
Additional fees apply for cancellation of airline tickets and other services, which will be advised as soon as possible after receipt of the written cancellation.
*Special cancellation terms apply for private group bookings and exclusive use of a camp, lodge or boat are subject to supplier not Moon Tours the agent.
Suppliers of products and services to Moon Tours and their respective clients are subject to local law and supplier Terms and Conditions. Any disputes or claims will be subject to local law and the supplier terms and conditions.
CLAIMS AND REFUNDS FROM MOON TOURS AS AN ACTING BOOKING AGENT FOR THIRD PARTY SUPPLIERS IE HOTELS, LODGES, AFRICAN SAFARIS, BOATS, RIVER CRUISERS & ANY OTHER CONTRACTED SERVICE OR ACCOMMODATION SUPPLIERS.
Moon Tours does not give refunds on behalf of any supplier products or service carried out by third parties in respect to Moon Tours as a booking agent for any missed services.
Travellers must take out their own personal travel insurance to cover for any missed service and will be subject to supplier Terms and Conditions.
LIMITS ON MOON TOURS RESPONSIBILITY
Moon Services Pty Ltd, trading as Moon Tours, its employees, shareholders, officers, directors, successors, agents and assigns, does not own or operate any entity which is to or does provide goods or services for your trip with the exception of a limited number of vehicles. It purchases transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers. All such persons and entities are independent contractors. As a result, Moon Tours, is not liable for any negligent or wilful act of any such person or entity or of any third person.
In addition and without limitation, Moon Tours, is not responsible for any injury, financial or physical loss, death, inconvenience, delay or damage to personal property in connection to the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transport mechanism to arrive or depart on time.
There are many inherent risks in adventure travel of the type involved here, which can lead to illness, injury or even death. These risks are increased by the fact that these trips take place in remote locations, far from medical facilities. Passenger assumes all such risks associated with participating in this trip.
In the event of a cancellation or material alteration to the trip as a result of the circumstances as described in this clause Moon Tours may in their sole and absolute discretion:
a) offer the traveller(s) alternative travel arrangements or products of comparable standard as may be appropriate in the circumstances; or
b) if alternative travel arrangements or products are not offered by Moon Tours, Moon Tours will make a prompt proportional refund of monies paid by the traveller.
Moon Tours may charge a reasonable fee to cover the administration costs associated with providing alternative travel arrangements or products.
If a material alteration becomes necessary within 90 days of the departure date for any reason other than the circumstances described in this clause, Moon Tours will endeavour to offer comparable products or a full refund of all monies paid by the traveller(s).
All accommodation, room type(s) and specification are as shown in the itinerary
Meals are as shown in the itinerary and non refundable
Transfers are shown in the itinerary and non refundable
Accommodation and arranged sightseeing are subject to change at any time due to unforeseen circumstances or circumstances beyond Moon Tours’s control. Every effort will be made to operate tours as planned, but alterations may occur after the final itinerary has been issued. Moon Tours also reserves the right to withdraw a tour or any part of it, to make such alterations to the itinerary or the tour inclusions as it deems necessary or desirable, and to pass on to tour members any expenditures or losses caused by delays or events beyond its control.
In case of any appreciable variation in the tour price due to these circumstances, Moon Tours reserves the right to make adjustments to the tour costs as necessary.
Specific requests should be advised at time of booking. Please note that every effort will be made to secure special requests, however; they cannot be guaranteed. Certain special requests may require upfront payments.
Transportation will be as specified in the itinerary.
Handling of baggage only as specified in the quotation. Weight restrictions for baggage on some routes on internal/domestic flights may apply; details of which will be provided with pre-tour documentation. Baggage and personal effects are at the owner’s risk throughout the tour and Moon Tours assumes no liability for lost or damaged baggage. Baggage insurance is strongly advised.
Please check with your international carrier for other baggage restrictions applicable to your international flight.
TAXES AND GRATUITIES
Hotel taxes as imposed by city and state governments are included. Airport taxes are included where specified in the itinerary.
Gratuities for guides, drivers, porters, camp staff, ship crew and Tour Managers are not included and are at the discretion of the traveller.
PRICES & ARRANGEMENTS
The tour price includes planning, handling and operational charges and is quoted based on the current rates of exchange and tariffs. Entrance fees as part of scheduled sightseeing tours are also included in this price. This price is subject to revision in line with significant changes in foreign currency, tariff rates, taxes etc.
The cost of obtaining passports, visas, excess baggage charges, items of a personal nature such as drinks, laundry, telephone calls, fax charges and excess baggage charges unless expressly included in writing, are not included in the tour price.
Moon Tours reserves the right to take photographs during the operation of any program or part thereof and to use them for promotional purposes. By booking a program with Moon Tours, travellers agree to allow their images to be used in such photographs. Travellers who prefer that their images not be used are asked to identify themselves to Moon Tours prior to final payment and they will be exempted from this photography waiver clause.
Please ensure that you consult your personal physician about anti malaria precautions and other inoculations and vaccinations before travel. Where applicable, please ensure that whilst travelling you carry a valid Yellow Fever certificate.
It is the responsibility of travellers to become informed about the most current travel advisories and warnings by referring to their respective government agencies. In the event of an active State Department or government agency Travel Warning against travel to specific destination location(s) of the trip, should the traveller still choose to travel, notwithstanding any travel advisory or warning, the traveller assumes all risk of personal injury, death or property damage that may arise out of the events like those advised or warned against.
Traveller(s) represent(s) that neither he or her nor anyone traveling with him or her has any physical condition or disability that could create a hazard to him or herself or other members of the tour. Moon Tours reserves the right to remove from the trip, at the sole expense of the traveller, anyone whose condition is such that he or she could create a hazard to himself or others, or otherwise impact the enjoyment of other passengers on the trip.
Airlines concerned are not to be held responsible for any act, omission or event occurring while passengers are not on board their aircraft. International air carriers are also subject to international air conventions limiting their liability. These limitations of liability are explained on the e-ticket or on the reverse of the airline ticket and when issued, this constitutes the sole contract between the respective air carrier(s) and their passengers.
PASSPORT & VISAS
Please note that passport holders are responsible for obtaining the required documentation applicable for entry. Please note also that passports must be valid for six (6) months before departure and should also have sufficient blank pages for visas and immigrations stamps. Moon Tours cannot be held responsible should you be denied entry to a country due to non-compliance with these requirements.
Moon Tours strongly recommend all clients take out comprehensive travel insurance at the time of booking and prior to date of travel. This insurance should cover cancellation and curtailment, all medical expenses including evacuation/repatriation, personal baggage, personal liability, death and permanent disability and travel document insurance. Moon Tours cannot be held responsible for any costs arising from such loss or injury.
Any claim arising out of or relating to these Terms and Conditions, to the Limits on Moon Services Pty Ltd, trading as Moon Tours, responsibility clause, to the brochure, to any information relating in any way to the trip, to the trip itself or to any products or services related to the trip, shall be settled in the first instance by binding arbitration in the applicable legal forum. In lieu of a personal appearance at arbitration the arbitration may be conducted by telephonic means. Arbitration is the exclusive forum in the first instance for dispute resolution and except as otherwise provided by statute, each party shall bear its own costs and expenses and an equal share of the arbitrator and administrative fees.

USD payments can be paid in AUD directly into the account shown on the invoice at the current exchange rate shown on the NAB foreign currency exchange calculator link below.
Moon Tours does not offer refunds in the event of third party providers such as hotels, tour operators, airlines or any other provider of product or service as a booking agent. Moon Tours does not offer refunds in the event of personal injury, airplane delay, mechanical breakdowns, weather, sickness, strikes, war, criminal acts, quarantine, acts of god or anything out of it’s control.
Guests must have valid travel insurance including emergency medical evacuation, dive medical and cancellation insurances.
